Termination & Discharge Policy – Solid Foundations
Solid Foundations, we are committed to maintaining the highest standards of professionalism, safety, and integrity in all our construction projects. However, under certain circumstances, it may become necessary to terminate a contract or discharge services. This Termination & Discharge Policy outlines the conditions, procedures, and responsibilities for both parties to ensure a fair and transparent process.
1. Grounds for Termination
A. Client-Initiated Termination
Clients may choose to terminate a contract for the following reasons:
✔ Change in project requirements or financial constraints.
✔ Dissatisfaction with the progress or quality of work (following attempts at resolution).
✔ Legal or regulatory issues preventing project continuation.
B. Company-Initiated Termination
Solid Foundations reserves the right to terminate a contract if:
✔ The client fails to make payments as per the agreed schedule.
✔ There is a breach of contract terms, including unauthorized design or scope modifications.
✔ Unforeseen circumstances (e.g., legal disputes, safety hazards) prevent project completion.
✔ The client engages in unethical or unlawful activities that impact the project.
2. Notice & Communication
✔ A formal written notice of termination must be provided by either party at least 14–30 days in advance, depending on contract terms.
✔ All outstanding work, payments, and project documentation will be reviewed during the notice period.
✔ If an immediate termination is required due to safety or legal issues, a written explanation will be provided, and the project will cease immediately.
3. Financial & Legal Obligations
✔ Any work completed prior to termination must be compensated as per the contract.
✔ If materials have been purchased or subcontractors engaged, cancellation fees may apply based on incurred costs.
✔ Refunds (if applicable) will be processed in accordance with the contract’s refund policy.
✔ Any disputes arising from termination will be addressed through mediation or legal action if necessary.
4. Project Handover & Transition
✔ All relevant documents, permits, and plans will be handed over to the client (if applicable).
✔ Solid Foundations will provide recommendations or alternative solutions for project continuation.
✔ If necessary, we will assist in transitioning to a new contractor in an organized manner.
5. Dispute Resolution
✔ If disagreements arise regarding termination, both parties will first seek amicable resolution through discussion.
✔ If unresolved, mediation or arbitration may be pursued as per contractual agreements.
